How to find a mutual health care insurance once I am abroad ?

As a rule it is best to enquire and subscribe before you go. Many brokers refuse to ensure a person who is already abroad.
It is always possible to find a international mutual health care insurance. A solution may also be found locally with a broker working in the country of expatriation. In that case, however, you will have to be careful of what the guarantees really cover: deductibles, caps on health benefits, and the possibility to be taken care of in your home country.
Nevertheless it’s always preferable to deal with a specialist who will be able to find a mutual insurance adapted to your country of expatriation, your age and the level of coverage you need

What is the use of individual accident coverage abroad ?

If you are employed or an independent worker in France, on top of your mutual health care insurance, you can benefit from pension guarantees, that is, the possibility to receive a pension in case of disability or a lump sum in case of death.
When you go abroad, it is important to make sure that you will be able to receive a lump sum in case of disability and that your family will receive a lump sum in case of death.
There may be a number of exclusions in individual accident insurance contracts and it is worthwhile to make sure you are well protected in your country of mission or expatriation and that the guarantees will be operating.

Is a firm responsible if an accident happens to me abroad ?

French law requires that employers ensure the safety of their employees throughout their professional assignment. Such requirement is important and the jurisprudence has several times confirmed that this was a security performance obligation of the employment contract.. « une obligation de sécurité de résultat » (Cass.Socapril 11 2002, N°00616.535).
Since 2001, the jurisprudence has ruled that any accident taking place during the course of a job assignment, whether in France or abroad, is deemed to be a work-related accident, whether it happened in the course of a professional actor in daily life. (Cass.Soc. July 19 2001,n°99-21-536). Therefore, in the course of an assignment abroad of an employee, accidents are considered work-related and the employer's’ responsibility may be established.

In addition to serious financial consequences, this may impact badly on the the firm’s image and eventually jeopardise its activity. It is thus important for the employer to look carefully into these questions with a view to protect its employees and its activities.
Therefore, if companies can demonstrate that they have taken all the necessary measures to protect the physical and mental health of their employees and ensure their safety, they will be deemed as having properly fulfilled their legal obligations.
Adopting policies designed to minimize personal risks fully and efficiently would prevent a firm from being condemned for having failed its safety obligations. This is why it is crucial that firms receive legal support on these questions.
